(hereinafter “PIN-CRAFT” or the “Data Controller”), through this Privacy Notice, wishes to inform visitors of the website https://pincraft.emdev.it/ (hereinafter the “Website”) about the policy adopted regarding the protection of personal data. Pursuant to Regulation (EU) 2016/679, PIN-CRAFT provides the following information.

Connection and Browsing Data
The IT systems and software procedures used to operate this Website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.
This category of data includes IP addresses or domain names of the computers and devices used by users, the URI/URL (Uniform Resource Identifier/Locator) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the server response status (successful, error, etc.), and other parameters relating to the user’s operating system and IT environment.
Such data are collected solely for the purpose of obtaining anonymous statistical information on the use of the Website and checking its proper functioning and are deleted immediately after processing.

The optional, explicit and voluntary sending of messages through the contact form entails the acquisition of the sender’s identification and contact data, as well as any other personal data necessary to respond to the requests submitted.

3. METHODS OF PROCESSING
The processing of your personal data will mainly be carried out using electronic means, including automated tools, in accordance with methods and instruments suitable to ensure the security and confidentiality of the data.
In particular, all appropriate technical and organizational security measures will be adopted in order to guarantee an adequate level of data protection as required by law, allowing access only to persons authorized to process the data by the Data Controller or by processors appointed by the Data Controller.
The information collected and the processing methods adopted will be relevant and not excessive in relation to the purposes pursued.
PIN-CRAFT stores personal data through servers mainly located within the European Economic Area (EEA). However, it reserves the right to use services located in non-EU countries; in such cases, service providers are selected among those located in countries deemed “adequate” pursuant to Art. 45 GDPR or those providing adequate contractual safeguards pursuant to Articles 46 et seq. of GDPR.
4. PURPOSES AND LEGAL BASES OF THE PROCESSING
The processing activities carried out through the Website are performed for the following purposes and on the following legal bases:
a) to allow you to browse the Website and use the services available through the dedicated sections;
b) to provide assistance and information upon request and respond to requests submitted through the “Contacts us”, “After sales and Dealers” forms, or by e-mail or telephone;
c) for recruitment and personnel selection purposes if you submit your application for one or more job positions available in the “Work with us” section. For further information on such processing, please refer to the specific privacy notice available in that section.
In the above cases, the legal basis for the processing is the performance of a contract and/or pre-contractual measures pursuant to Art. 6(1)(b) GDPR.
d) to comply with obligations imposed by laws, regulations, or orders issued by competent authorities and law enforcement agencies. The legal basis for such processing is compliance with a legal obligation pursuant to Art. 6(1)(c) GDPR.
e) for technological maintenance and updating of the Website. The legal basis for such processing is the Data Controller’s legitimate interest in the security and maintenance of the Website pursuant to Art. 6(1)(f) GDPR.
f) for sending commercial, promotional and informational communications concerning the company and the products and services it offers, through subscription to the newsletter in the “Contact us” section of the Website. The legal basis for this processing is your explicit consent pursuant to Art. 6(1)(a) GDPR, which may be withdrawn at any time. For further information, please refer to the specific privacy notice available in the relevant section.
5. NATURE OF THE PROVISION OF DATA AND CONSEQUENCES OF FAILURE TO PROVIDE DATA
Providing data for the purposes referred to in points a), b) and c) of Section 4 above is necessary in order to use the services offered through the Website. Failure to provide, partial provision or inaccurate provision of such data may make it impossible to browse the Website and satisfy your requests.
For the purpose referred to in point d) of Section 4, providing data is mandatory by law; failure to provide such data may make it impossible to provide the services offered due to the inability to comply with legal obligations.
For the purpose referred to in point e) of Section 4, the data subject provides data on the basis of the prevailing legitimate interest of the Data Controller; for the right to object, please refer to Section 8.
For the purpose referred to in point f) of Section 4, the provision of data is optional.
6. RECIPIENTS OF THE DATA
Users’ personal data may be disclosed to the following categories of recipients:
a) Opacmare S.p.A., as majority shareholder of PIN-CRAFT, as well as external service providers engaged by PIN-CRAFT to provide technical services (e.g. hosting and technological maintenance of the Website) and organizational services necessary for Website management;
b) entities (Judicial Authorities, law enforcement agencies) entitled to access personal data pursuant to legal or administrative provisions;
c) recruitment agencies for the purpose of reviewing your application and, where applicable, managing the recruitment process.

Data processors are bound by appropriate contractual obligations pursuant to Art. 28 GDPR in order to implement adequate security measures to protect the security and confidentiality of personal data.
7. RETENTION PERIOD OF PERSONAL DATA
PIN-CRAFT retains your personal data for the period strictly necessary to achieve the purposes indicated above. In particular, PIN-CRAFT applies the following retention periods:
- for contact/information/support requests your personal data will be retained for the time necessary to process the request;
- for Website maintenance: data will be processed for the time necessary to carry out maintenance and/or updating activities.
With reference to the additional processing purposes referred to in Section 4, the data will be retained according to the provisions set out in the specific privacy notices available on the Website.

8. DATA SUBJECT RIGHTS
Pursuant to Articles 15–22 of Regulation (EU) 2016/679, you, as a data subject, are entitled to exercise the following rights:
- Right of access: pursuant to Art. 15 GDPR, you have the right to obtain confirmation as to whether or not personal data concerning you are being processed and, where that is the case, to obtain a copy thereof. You also have the right to access your personal data and additional information such as the purposes of the processing, the categories of recipients, the retention period and the rights exercisable.
- Right to rectification: pursuant to Art. 16 GDPR, you have the right to obtain the rectification of inaccurate personal data concerning you and the completion of incomplete personal data.
- Right to erasure: you have the right to obtain the erasure of personal data concerning you without undue delay where one of the grounds provided for in Art. 17 GDPR applies.
- Right to restriction of processing: in the cases provided for under Art. 18 GDPR, you have the right to obtain restriction of processing.
- Right to data portability: you have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format and to transmit such data to another controller without hindrance, pursuant to Art. 20 GDPR.
- Right to object: you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR.
- Right to lodge a complaint: pursuant to Art. 77 GDPR, you also have the right to lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy.it).
The rights listed above may be exercised by sending an informal request to the Data Controller by post using the contact details indicated above or by e-mail to info@pin-craft.com.
In the event of violations or denial of privacy rights, data subjects may also contact the Group Data Protection Officer (DPO) by writing to dpo@opacmare.it.
9. DATA PROTECTION OFFICER
The Data Controller has appointed a Data Protection Officer (“DPO”) operating for the Opacmare Group, of which PIN-CRAFT is part. The DPO may be contacted at dpo@opacmare.it for all matters relating to the processing of personal data and the exercise of rights pursuant to the GDPR and according to the procedures described in Section 8 of this Privacy Notice.
10. REVIEW CLAUSE
PIN-CRAFT reserves the right to review this Privacy Policy at any time. The most recent version of the Privacy Policy is always available on the Website.
